These Terms of Use (the "Terms") are a binding agreement between you and Frame Craft ("Frame Craft", "we", "us", or "our"), the operator of framecraft.ca (the "Site"). By accessing, browsing, creating an account, uploading content, or placing an order with us, you accept these Terms. If you don't agree with any part of them, please don't use the Site.

1. Your use of the Site

In short: Use the Site for your own personal orders. Don't hack it, scrape it, automate against it, or use it to harm others.

You may use the Site to browse, upload photos, place orders, and manage your account. You agree NOT to:

  • use the Site for any unlawful purpose, or in a way that violates Canadian, provincial, or local law;
  • copy, modify, reverse-engineer, decompile, or attempt to extract the source code of the Site or our software;
  • scrape, crawl, harvest, or use automated means (including bots, scripts, or headless browsers) to access the Site, except for well-behaved search engine indexers;
  • resell, sublicense, rent, or commercially exploit the Site, its content, or any service offered through it, without our prior written permission;
  • circumvent, disable, or interfere with security features, rate limits, or access controls;
  • impersonate any person or entity, or misrepresent your affiliation with anyone;
  • upload viruses, malware, or other harmful code;
  • harass, threaten, defame, or attempt to identify or contact other Frame Craft customers; or
  • use the Site in a way that could damage our reputation, infrastructure, or systems.

We reserve the right, at our sole discretion, to refuse service, cancel orders, suspend accounts, and decline any upload that we reasonably believe violates these Terms or applicable law — with or without prior notice.

2. Your account

In short: You must be the age of majority in your province (18 or 19) to have an account. You're responsible for what happens under your account.

To place an order or upload photos, you may need a Frame Craft account. By creating an account, you represent and warrant that:

  • you are at least the age of majority in your province or territory of residence (18 or 19 in Canada);
  • the information you provide is accurate, current, and complete, and you will keep it updated;
  • you will keep your password confidential and not share access to your account;
  • you are responsible for all activity that occurs under your account, including all orders placed and all content uploaded; and
  • you will notify us promptly at [email protected] if you suspect any unauthorized access.

We may decline to register an account, or close an existing account, at our discretion — for example, if we believe an account is being used to violate these Terms or applicable law.

3. Orders, pricing & payment

In short: Prices are in CAD. We charge at checkout. We may correct obvious pricing mistakes, and we may refuse or limit any order.
  • Currency: All prices on the Site are in Canadian dollars (CAD) unless explicitly stated otherwise.
  • Payment: Payments are processed by Stripe, Inc. You authorize us (through Stripe) to charge your payment method for the total amount of your order, including any applicable taxes and shipping, at the time the order is placed.
  • Taxes: GST/HST and any applicable provincial sales tax will be calculated and added at checkout based on your shipping address.
  • Order acceptance: Your placement of an order is an offer to purchase. We accept the offer when we send you an order confirmation email. We may decline to accept an order, in whole or in part, at our discretion — for example, if the product is unavailable, if we suspect fraud, if shipping is unavailable to your location, or if a pricing error has occurred.
  • Pricing errors: If a product is listed at an incorrect price due to a typographical or system error, we may cancel the order and refund any amount charged, whether or not the order has been confirmed.
  • Promotional codes: Discount codes and promotions are subject to their own terms (e.g., expiry date, minimum order value, single-use). We reserve the right to decline or revoke any code we believe is being used in violation of its terms.
  • Order limits: We may limit the quantity of any item that can be purchased per customer, per order, or per household.

4. Custom products & cancellation

In short: Each frame is made just for you, so we can't accept returns for change of mind. You have 2 hours to cancel; after that, production starts.

Every Frame Craft order is a custom-made product, manufactured to your specifications (size, finish, and the photo you upload). By placing an order, you acknowledge that:

  • You confirmed the photo, crop, and size in the preview before checkout. What you saw in the final preview is what we will print.
  • Custom products are not eligible for return or refund based on change of mind, buyer's remorse, ordering the wrong size, or dissatisfaction with the photo content itself.
  • Cancellation window: You may cancel an order at no cost up to 2 hours after placing it, by emailing [email protected] with your order number. Once production has started, the order cannot be cancelled.

This section does not limit your rights in respect of products that arrive damaged or that are materially defective — see Section 5.

5. Shipping, risk of loss & damaged shipments

In short: We ship via Imagineship DDP (duties prepaid) to Canadian addresses. Typical delivery is 14–21 days. We replace items damaged in transit.
  • Coverage: We currently ship only to addresses in Canada.
  • Delivery time: Approximately 14–21 days from order, comprising up to ~3 days for production, up to ~15 days for international transit, and up to ~3 days for last-mile delivery within Canada. Delivery times are estimates, not guarantees.
  • DDP: All duties and taxes are prepaid through our shipping partner Imagineship. You will not be asked to pay duties or customs fees at the door.
  • Risk of loss: Title and risk of loss to physical products pass to you upon delivery by the carrier to the shipping address you provided.
  • Address accuracy: You are responsible for providing a complete and accurate shipping address. We are not responsible for orders shipped to an incorrect address that you supplied. If a package is returned to us as undeliverable due to an incorrect address, you will be responsible for any re-shipping costs.
  • Damaged on arrival: If your order arrives damaged, please email [email protected] within 48 hours of delivery with your order number and clear photos of the damage. We will ship a replacement at no cost; you do not need to return the damaged item.
  • Material defects: For manufacturing defects not visible at delivery (e.g., a cracked panel discovered after unboxing, faulty hardware), contact us within 14 days of delivery for replacement.
  • Lost packages: If carrier tracking shows your package as delivered but you have not received it, please check with neighbours, building staff, and your local carrier office first. If still unrecovered, contact us within 7 days of the marked-delivered date and we will investigate with the carrier.

6. Photos & content you upload

6.1 You own your photos

In short: You keep ownership of every photo you upload. We don't claim any rights to them beyond what we need to print and ship your order.

All photos, images, text, and other content you upload to Frame Craft ("Your Content") remain your property or the property of the original rights-holder. Uploading Your Content to Frame Craft does not transfer any ownership of it to us.

6.2 Limited licence you grant to Frame Craft

By uploading Your Content to Frame Craft, you grant us a limited, non-exclusive, royalty-free, worldwide licence to host, store, copy, transmit, reproduce, reformat, crop, and print Your Content solely for the purpose of producing, fulfilling, and delivering your order. This licence ends when your order is fulfilled or cancelled, except that we may continue to retain copies as reasonably necessary to maintain order history, comply with our legal obligations, resolve disputes, and enforce these Terms. We will not use Your Content for marketing, training of artificial intelligence systems, or any other purpose without your specific written permission.

6.3 Your representations and warranties about Your Content

By uploading Your Content, you represent and warrant that:

  • you own Your Content, or you have all rights, licences, consents, and releases necessary to print and use it for the purpose described above;
  • Your Content does not infringe any third party's copyright, trademark, trade-mark, right of publicity, right of privacy, or any other right;
  • if Your Content depicts any identifiable person other than yourself, you have obtained any consents required under applicable law to use their likeness; and
  • Your Content does not violate any law applicable to you or to us.

6.4 Prohibited content

In short: We'll print just about anything legal. The exceptions are content that is unlawful in Canada — that's the only line.

Frame Craft is permissive about what you can print: family photos, art, personal projects, gifts, professional work, and adult creative content for personal use are all welcome. You may not, however, upload or order any content that is unlawful under Canadian federal or applicable provincial law, including (without limitation):

  • any sexual content involving, depicting, or appearing to depict a person under 18 years of age (this is a strict, no-exceptions prohibition under Canadian law);
  • non-consensual intimate imagery of any person;
  • content the publication of which would constitute hate propaganda under the Canadian Criminal Code;
  • content that is obscene as defined by Canadian law;
  • content that depicts an actual crime or that promotes or counsels the commission of a crime; or
  • content you do not have the legal right to print (e.g., images you scraped from a third party, photos of identifiable people who have not consented, copyrighted images or art for which you do not hold a licence).

We reserve the right to review, refuse, and refund any order at our sole discretion — particularly if we have any reason to suspect a violation of this Section 6.4 — and to report unlawful content to the appropriate authorities as required by law.

7. Copyright & right-of-publicity complaints

In short: Believe someone ordered a print that infringes your rights? Email us with the details and we'll investigate quickly.

We respect intellectual property rights and operate a notice-and-takedown process consistent with the Copyright Act (Canada) and Canada's Notice and Notice regime.

If you believe content uploaded to Frame Craft infringes your copyright, trademark, right of publicity, or other rights, please email [email protected] with:

  • your name, address, telephone number, and email address;
  • a description of the work you say is being infringed, with enough detail for us to identify it (e.g., a URL, registration number, or copy of the original);
  • identification of the allegedly infringing content (e.g., order number if you have it, screenshot, or other description);
  • a statement that you have a good-faith belief that the use is unauthorized;
  • a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights-holder or authorized to act on behalf of one; and
  • your physical or electronic signature.

We will review properly submitted notices promptly. We may, in our discretion, suspend orders, remove uploaded content, terminate accounts of repeat infringers, and forward your notice to the customer who uploaded the content, as required by the Notice and Notice regime.

8. Emails & communications (CASL)

In short: We'll always email you about your orders. We'll only send marketing if you opt in — and you can unsubscribe any time.

Frame Craft complies with Canada's Anti-Spam Legislation (CASL). By placing an order, you consent to receive transactional emails from us related to your order — confirmations, production status, shipping notifications, delivery confirmation, and reasonable post-purchase communications such as defect or product-safety notices. You cannot opt out of transactional emails while an order is in progress.

We will send you commercial / marketing emails (e.g., promotions, new products, studio notes) only if you have explicitly opted in. Every marketing email contains a one-click unsubscribe link, and we will honour your unsubscribe request promptly and at no cost.

9. Our intellectual property

The Site and all of its content (other than Your Content) — including the "Frame Craft" name and logo, the design and layout of the Site, our product photography, illustrations, copy, code, fonts, and the Site's underlying software — are owned by Frame Craft or our licensors and are protected by Canadian and international copyright, trademark, and other laws.

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and use the Site for the purposes described in these Terms. Except as expressly permitted, you may not copy, reproduce, modify, distribute, display, publicly perform, republish, or create derivative works from the Site or its content without our prior written consent.

10. Disclaimer of warranties

In short: We do our best to keep the Site working and to make every order look great. Nothing on the internet is perfect; this section spells out what we're not promising.

THE SITE AND ALL CONTENT, SERVICES, AND PRODUCTS PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. WITHOUT LIMITING THE FOREGOING, FRAME CRAFT DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components, or that defects will be corrected.

Colours and finish may vary slightly between what you see on your screen and the printed product; this is a natural consequence of digital-to-physical reproduction and is not a defect. Wood grain patterns vary naturally between panels and are not defects.

Quebec residents: The disclaimers in this section apply only to the extent permitted by the Consumer Protection Act (Quebec) and the Civil Code of Quebec. Nothing in these Terms is intended to remove the legal warranty of quality or any other right you have as a consumer under Quebec law that cannot be waived. Other provincial consumer protection laws apply similarly.

11. Limitation of liability

In short: If something goes wrong, our maximum responsibility is the amount you paid for the order in question. We're not liable for indirect or consequential losses.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FRAME CRAFT (INCLUDING ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY PRODUCT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY EVENT, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY PRODUCT WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM, OR (B) CAD $100.

Some provinces, including Quebec, do not allow the limitation or exclusion of liability for certain types of damages. If those laws apply to you, some or all of the above limitations may not apply, and you may have additional rights. Nothing in these Terms is intended to limit any rights you have under applicable consumer protection law that cannot be waived.

12. Your indemnification of Frame Craft

In short: If someone sues us because of a photo you uploaded (e.g., it wasn't yours to print, or it infringes someone's rights), you agree to cover our reasonable costs.

You agree to defend, indemnify, and hold harmless Frame Craft and our directors, officers, employees, contractors, and agents from and against any and all claims, demands, suits, proceedings, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your Content or any use we make of Your Content as permitted by these Terms;
  • your violation of any third party's intellectual property, privacy, publicity, or other rights;
  • your violation of these Terms or any applicable law; or
  • your use of the Site or any product purchased through the Site in a manner not permitted by these Terms.

We will provide you with prompt notice of any such claim and reasonable cooperation in the defence. We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate in our defence of that claim.

13. Suspension & termination

We may suspend, restrict, or terminate your access to the Site or any product or service, with or without notice, if we reasonably believe that:

  • you have violated these Terms or applicable law;
  • your account has been compromised or is being used fraudulently;
  • your continued use poses a security risk or could result in financial loss to us or to other users; or
  • we are required to do so by law or by a competent authority.

You may close your account at any time by emailing [email protected]. On account closure, we will delete or anonymize your personal data and Your Content according to our Privacy Policy, subject to any retention period required for tax, accounting, or legal-compliance purposes.

Sections that by their nature should survive termination (including ownership of Your Content, our intellectual property, disclaimer of warranties, limitation of liability, indemnification, and dispute resolution) will survive.

14. Events beyond our control

Frame Craft will not be liable for any delay or failure to perform our obligations under these Terms where the delay or failure results from an event beyond our reasonable control, including (without limitation) acts of God, fire, flood, severe weather, earthquake, epidemic or pandemic, war, terrorism, civil unrest, government action or restriction, labour disputes, carrier delays, supplier failures, internet or telecommunications outages, or shortages of materials. We will make reasonable efforts to notify you of any material delay caused by such an event.

15. Disputes & governing law

In short: We'd much rather sort things out by email. If we can't, disputes go to the courts of Ontario under Ontario law (with respect for your provincial consumer rights where applicable).

Step 1 — Good-faith resolution: Before commencing any legal action, you agree to first email us at [email protected] with a description of the dispute and the resolution you're seeking. Frame Craft will respond within 30 days. Most issues — including damage, defects, shipping problems, and refund questions — can be resolved this way.

Step 2 — Courts: If we can't resolve the dispute informally within 30 days of your written notice, the dispute will be resolved by the courts of the Province of Ontario, and you and Frame Craft submit to the exclusive jurisdiction of those courts, subject to any non-waivable rights you have under the law of your province or territory of residence to bring an action in your local courts. Small-claims matters may be brought in the small-claims court of either party's jurisdiction.

Governing law: These Terms and any dispute arising out of or relating to them or your use of the Site are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in that province, without regard to its conflict-of-laws rules, except where the consumer-protection laws of your province of residence require otherwise. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Quebec residents: If you reside in Quebec at the time the dispute arises, you may bring suit in the courts of Quebec. Nothing in this section prevents you from filing a complaint with the Office de la protection du consommateur or invoking the protections of the Consumer Protection Act (Quebec).

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date at the top of this page and, where required by law, notify you in advance — for example, by email if you have an account, or by a prominent notice on the Site. Continued use of the Site after the effective date of updated Terms constitutes your acceptance of them. If you don't agree to the updated Terms, please stop using the Site and contact us so we can close your account.

17. General

  • Entire agreement. These Terms, together with our Privacy Policy and any order confirmation, constitute the entire agreement between you and Frame Craft regarding your use of the Site, and supersede any prior agreements between us on the subject.
  • Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.
  • No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that or any other provision later.
  • Assignment. You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, financing, or sale of all or substantially all of our assets.
  • No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.
  • Language. These Terms have been prepared in the English language. Les parties confirment leur volonté que cette convention soit rédigée en anglais.
  • Notices to you. We may give you notice by posting on the Site, by email to your registered email address, or by any other reasonable means.
